A notary is the person who makes your property purchase, your mortgage and your power of attorney official in Spain. Most expats meet one for the first time on signing day, and many arrive without knowing what the notary will and will not check. This page explains the role and then lists the offices we would consider.
Notaries in Barcelona
Notaries in Barcelona work from small offices called notarías, usually open on weekdays only. Of the 103 offices we list, 56 are in the Eixample and 23 in Sarrià-Sant Gervasi. A handful sit in Gràcia, Sants-Montjuïc, Les Corts and Sant Martí, which matters if you want an office near home. The Eixample and Sarrià-Sant Gervasi districts are covered in the Eixample hub and the Sarrià-Sant Gervasi hub.
The notary is not a lawyer for one side. According to the Spanish notaries' council, a notary gives free and impartial advice, acts for all parties and pays particular attention to the party who needs the most protection. That is different from the lawyer we describe in real estate lawyers in Barcelona, who works for you alone.
What does a notary do in a Spanish property purchase?
The notary reads the deed to the parties, checks it complies with the law and has everyone sign the escritura, the public deed of sale. In a purchase the notary also records the price and the identities of buyer and seller. After signing, the deed goes on to the property registry and the tax offices, which a gestoría often handles for you (see gestorías in Barcelona).
What the notary does not do is protect you from a bad deal. Checking debts on the flat, planning problems, the seller's tax position and the fairness of an earlier deposit contract is your lawyer's job. Our overview of the whole sequence is in buying property in Barcelona.
Notary public offices in Barcelona
A notary public office handles more than property deeds. The notaries' council lists the kinds of notarial document on its site, including sales contracts, powers of attorney, wills and minutes of meetings. It defines a power of attorney as an entitlement granted by one person to another to perform and execute certain legal and material acts, which the principal can later revoke by another authentic instrument. The full list is on types of notarial documents.
A power of attorney is the one expats ask about most. If you buy a flat while living abroad, you can sign a poder so someone in Barcelona can sign the deed for you. The detailed rules for notarising a foreign power of attorney are not something we could confirm from an official source, so ask the notary which form they accept and whether they need an apostille.
Who chooses the notary, and who pays?
In general you can choose your notary freely, as the notaries' council states. In a purchase the buyer usually picks and the seller agrees, but nothing forces you to use a notary suggested by the agency or the bank.
For mortgages the law is explicit. Under Ley 5/2019 on real estate credit contracts, the borrower attends a notary of their own choice for personal advice no later than the day before the deed is signed, and that advice record carries no notarial fee. The same law assigns the notary fees of the mortgage deed to the lender, while the buyer still pays the purchase deed. We explain how this fits with a broker in mortgage brokers in Barcelona.
Are notary fees regulated in Spain?
Yes. Notary fees come from an official scale, the arancel, approved by Real Decreto 1426/1989 in the BOE. The decree says fees are calculated on the value of the transaction and bars the notary from charging for advice on the act being documented. That is why the base price for the same deed should be the same at any notary.
We do not quote a euro figure, because the scale has stepped percentages and later amendments, and the final bill also depends on pages and copies. Some offices apply a discount permitted by later rules. What we would do: ask two or three notaries for a written estimate for your exact deed and compare, rather than trusting a calculator.

Can I find an English-speaking notary in Barcelona?
You can search, but you should always confirm. The notaries' council has a "Choose your notary" tool that filters by name, postal code, town and foreign language, and it is the official place to begin. The language filter is useful, but a notary who speaks English still reads the deed in Spanish or Catalan, so ask the office in advance how they handle a client who does not follow either. Ask early, because signing day is not the moment to find out.
Our shortlist
We chose these from the ranked list for different needs. The reviews are Google reviews, and we have not visited any of these offices.
Most reviewed:Notaría Barcelona in Sant Gervasi, with 2,878 reviews at 4.9. It opens until 7 pm on Thursdays.
Best in the Eixample with volume:JLA Notaris in the Antiga Esquerra, with 1,543 reviews at 4.9 and weekday afternoon hours.
Take originals, not copies, and ask for the exact list from the office a few days before. A typical list for a purchase is your passport, your NIE, the details of the property, proof of payment and any mortgage paperwork. Your lawyer or gestor can send the draft deed ahead so you read it before signing day. Do not sign something you have not understood, and ask the notary to explain any clause. That is exactly what they are there for.
Frequently asked questions
What does a notary do in Spain?+
A Spanish notary is a public official who authenticates documents, checks that they comply with the law and gives free, impartial advice to the parties, according to the Spanish notaries' council. Typical documents are property deeds, mortgage deeds, wills and powers of attorney. A notary does not act for just one side like a lawyer does.
Who chooses the notary when buying a property in Barcelona?+
You can freely choose your notary, says the Spanish notaries' council. In practice the buyer usually picks the one for the purchase deed, and the seller may agree. For a mortgage, Spanish law says the borrower appears before a notary of their own choice for the pre-signing advice, so a bank cannot force one on you.
Are notary fees regulated in Spain?+
Yes. Notary fees for deeds are set by an official scale, the arancel notarial, approved by Royal Decree 1426/1989 and published in the BOE. The fee depends mainly on the value of the transaction and the number of pages and copies. The scale also bars notaries from charging for advice on the act they are documenting.
Can I find an English-speaking notary in Barcelona?+
Yes, you can search. The Spanish notaries' council has a notary finder that filters by name, postal code, town and foreign language. Check the language directly with the office before booking, and ask what they need from you if you do not speak Spanish well enough to follow the deed.
What should I bring to the notary?+
Bring your original passport and NIE, and your tax number if it is separate. Ask the notary's office for the full list, because it changes with the deed. For a purchase that normally includes the title deed or registry details of the property, the agreed price and payment method, and your mortgage documents if you have one.
